About This Course
The Disciplinary Procedures course provides a comprehensive guide to managing disciplinary issues in the workplace fairly and lawfully. Employers who fail to follow fair procedures risk claims of unfair dismissal under the Unfair Dismissals Acts 1977-2015, which can result in significant financial penalties and reputational damage.
The course covers the stages of a typical disciplinary procedure, from informal counselling and verbal warnings through to written warnings, final written warnings, and dismissal. Learners will understand the importance of conducting thorough investigations, providing the employee with written notification of the allegations, allowing the employee to respond fully, and offering the right to representation at disciplinary meetings.
The principles of natural justice and fair procedures are central to the course, including the right to be heard, the right to an impartial decision-maker, and the right to appeal. The course also covers the distinction between misconduct and gross misconduct, the appropriate use of suspension, and the importance of maintaining detailed records throughout the disciplinary process.
The role of the Workplace Relations Commission (WRC) and the Labour Court in adjudicating on unfair dismissal claims is also explained, providing learners with a clear understanding of the potential consequences of procedural failures.
Who Is This Course For?
This course is suitable for managers, supervisors, team leaders, HR professionals, and business owners who may be involved in managing disciplinary matters. It is also valuable for employee representatives and anyone who wishes to understand how disciplinary procedures should be conducted fairly and in accordance with Irish employment law.
