Manager Liability Under Section 80
This course covers Section 80 of the Safety, Health and Welfare at Work Act 2005, which establishes personal liability for directors and managers.
⚠️ Personal Liability for Managers
Section 80 provides that a director, manager, or other similar officer of an undertaking may be deemed guilty of the same offence as the undertaking if the acts that constituted the offence were:
- Authorised by the director or manager
- Consented to by the director or manager
- Attributable to connivance or neglect on the part of the director or manager
For example: Ignoring a safety and health issue could constitute neglect.
“Section 80(2) states that if a person is proceeded against under that section then it is presumed, until the contrary is proved, that the breach or neglect was authorised by them.
